Website build and hosting terms

Version 1.0. Effective 19 September 2026.

The package at a glance

  • Website build included with managed hosting. Pricing is discussed individually and agreed in a written quote before you commit. No upfront build fee.
  • Up to five static pages using your content, with two rounds of revisions before launch.
  • Six-month initial hosting term. Your quote states the monthly charge and total cost for those six months, with any extras listed separately. Billing starts when you approve launch.
  • After six months, hosting continues monthly until cancelled with 30 days’ notice. You can give notice during the initial term to end at its expiry.
  • Backups are optional and are not included in the base package. Backups, domain registration and renewal, contact forms and other extras are priced separately and agreed before we incur costs.
  • You own the completed bespoke website and can request its files without a release fee.
  • Consumer cooling-off rights and rights where the service is faulty are explained below. Early cancellation is not subject to an automatic demand for all remaining payments.

We are not VAT registered. No VAT is added to our quoted prices.

1. Who we are

We are Intervirtue Ltd, registered in Scotland, company number SC823061. Our registered office and correspondence address is 21 Easter Hawhill Wynd, Uddingston, Glasgow, Scotland, G71 7TY.

Email [email protected] for enquiries, support, complaints or cancellation. You can also cancel by writing to the address above.

These terms cover this website package for individuals and businesses. A consumer is an individual acting wholly or mainly outside their trade, business, craft or profession.

2. Agreeing your order

An enquiry does not create a contract. We send you a written proposal setting out the page list, scope, monthly package charge, total cost for the initial six months, any extras and their total prices, payment method and due dates, and an agreed delivery schedule. You accept it in writing; the contract is formed when we confirm your order by email.

Before you accept, we provide these terms and the cancellation information in a form you can keep. Our confirmation includes a copy of the agreed proposal and terms. Any agreed variation must be identified expressly in writing; it cannot remove your statutory rights.

The contract starts on order confirmation, but the six-month hosting term and monthly billing start only when you approve launch. We will confirm that date and the initial term’s end date in writing. Silence is not launch approval.

3. What the build includes

The package covers a static informational website, such as a personal site, portfolio or small-business marketing site, with up to five pages. Static pages present content rather than providing customer accounts, databases or online transactions. We agree the page list before starting.

We build a responsive layout for phones, tablets and computers using the text, images and other content you supply. Two rounds of revisions are included before launch. Each round is one consolidated list of changes within the agreed scope. Correcting our errors or bringing work into line with the agreed specification does not use up a revision round or cost extra.

You must have permission to use the content you supply. You retain ownership of it. You give us permission to use it only as needed to build, host and support your website. We will ask you to review the site and approve publication.

If content or feedback is delayed, we will discuss a revised schedule and may pause work. We do not start billing, deem the site approved or add delay charges merely because you have not replied. If either side wants to abandon the project, the cancellation provisions below apply.

4. Extras and domains

Backups, extra pages, further design revisions, ongoing content editing, copywriting, contact forms, shops, booking systems, custom applications, email mailboxes and paid third-party services are not included in the monthly package. We discuss and price these separately. No additional chargeable work or purchase begins without your agreement to its scope and price.

You can supply an existing domain or ask us to arrange one. You pay the separately agreed registration and renewal costs. Before a purchase, we confirm the domain, registration period, registration and renewal prices, any setup charge and the renewal arrangements. Where a future renewal price is not yet available, we explain this and obtain your agreement to the price before renewing on your behalf.

The domain is registered in your name or your organisation’s name, with you as the registrant. We provide access or transfer assistance needed to keep control of it. Registry or registrar transfer charges, if any, are disclosed separately; we do not charge a domain release fee. Ending hosting does not automatically cancel a separate domain registration or renewal instruction.

5. Managed hosting and support

We manage the hosting setup, HTTPS certificate and hosting-related technical maintenance. Scheduled backups and restoration from backups are not included in the base monthly package.

Managed backups are an optional, separately quoted service. Before you order them, we agree the price, files or data covered, backup frequency, retention period, restoration service and any restoration charges, and what happens to backups when the service ends. We do not activate or charge for this extra without your agreement.

Without the backup option, we do not promise historical recovery copies of your site. We recommend keeping your own copies of supplied content and requesting the website files provided under section 9. File handover is not an ongoing backup service. This does not remove our responsibility to perform the agreed service with reasonable care and skill or your rights if we fail to do so.

Email support is available Monday to Friday, 9am to 5pm UK time, excluding Scottish bank holidays. It covers hosting problems and faults in our work, not new features or routine content changes. There is no guaranteed response time, round-the-clock support or contractual uptime percentage.

We use reasonable care to keep the service available and secure. Planned maintenance or faults can cause interruptions; where practicable, we give advance notice of planned disruption and keep you informed about significant problems. This does not exclude your rights if we fail to provide the agreed service.

6. Payment and continuation

The monthly package charge is agreed individually. Your written proposal states that charge and the total payable for the initial six-month hosting term before you accept it. There is no separate upfront build charge. Payment dates and method are also stated in your proposal. Extras are payable only on the separately agreed terms.

After the initial term, hosting continues on a rolling monthly basis; it does not renew into another fixed six-month commitment. We do not change the agreed price during the initial term. After it, we give at least 60 days’ written notice of any proposed price change, including a change caused by VAT registration. You can end the service before a new price takes effect by giving 30 days’ notice, without an exit fee.

If you dispute an invoice, tell us why so we can investigate. We will not suspend service solely because of a genuinely disputed amount while we work with you to resolve it. Please pay any undisputed amount when due.

7. Consumer cooling-off period

If you are a consumer, you can cancel this package without giving a reason within 14 days after the day the contract is formed. This period starts at order confirmation, not at launch. We provide this cancellation right for the package even where the statutory distance-contract rules would not otherwise apply. Any longer cancellation period required by law still applies.

To cancel, send a clear statement by email or post using the contact details in section 1. You may use the form below, but do not have to. It is enough to send your cancellation before the deadline; our acknowledgement is not a condition of cancellation.

We normally wait until this period has ended before beginning work. You may expressly request an earlier start by email. Starting early does not waive your cooling-off right. If you cancel the package within this period, we make no charge for package work or hosting supplied during it and refund any package payments within 14 days of being told, using the same payment method unless you agree otherwise, without a refund fee.

Separately ordered extras require their own agreed scope, price and cancellation information before purchase. We do not assume that a bespoke website or domain purchase automatically removes consumer cancellation rights.

8. Ending the service and early cancellation

To end hosting, email or write to us. We confirm the end date and any final account. Moving your website elsewhere does not itself give us notice to cancel.

You may give 30 days’ notice at any time to end hosting on or after the end of the initial six-month term. There is no exit fee for doing so. After the initial term, notice ends the service 30 days after we receive it unless you request a later date. We charge only up to the end date, proportionately for any partial billing month, and refund prepaid hosting for later days within 14 days of the end date.

Outside the cooling-off period, if you ask to abandon the build before launch or end hosting before the initial term expires, we explain any proposed early-cancellation charge in writing. It is limited to our reasonable, evidenced net loss directly caused by cancellation, taking account of work already done, payments received, costs saved and reasonable steps to reduce that loss. We do not recover the same loss twice or charge an arbitrary build fee.

Any such charge cannot exceed the unpaid balance of the total package price for the initial six months stated in your accepted proposal, after allowing for package payments and sums already due. This is a ceiling, not an automatic charge: the actual amount may be lower or zero. Separately agreed extras are accounted for separately, subject to your legal rights.

No early-cancellation charge applies where you have a legal right to end the contract because of our breach. The initial term does not remove your rights to remedies for faulty work or failure to supply the service.

9. Ownership and leaving

You own the completed bespoke website work we create for you. We will provide written confirmation of the transfer of our rights in that work and, on request, its source files, site assets and build instructions without a release fee. Ownership and file handover are not conditional on keeping our hosting. Any properly due payment obligation is dealt with separately.

Third-party software, fonts, images and other licensed components remain subject to their own licences, rather than becoming your exclusive property. We identify material licence restrictions and recurring costs before you accept them. Hosting infrastructure, service accounts and our pre-existing tools are not transferred, but we provide the rights and files needed to use the completed site, subject to those disclosed third-party licences.

You can take the site to another provider. File handover is included; work to install, migrate or configure it elsewhere is quoted separately before being undertaken. A separately supplied form or integration may need replacement credentials, hosting or a licence from its provider.

We retain a retrievable copy of the website files for 30 days after hosting ends. Request your copy during that period, or earlier. This handover copy remains included whether or not you buy the backup option. After that period, we delete the hosted files and handover copy. If you ordered backups, their expiry and deletion follow the separately agreed backup terms. Records we must retain for legal or accounting purposes are kept separately. Any separately agreed personal-data processing terms take precedence for the data they cover.

10. Suspension or termination by us

Do not use the service for unlawful content or activity, infringement of others’ rights, malware, spam or activity that compromises the service or other users.

For an overdue undisputed payment or another remediable breach, we explain the issue in writing and allow at least 14 days to put it right before suspending or ending service. We may act sooner where reasonably necessary to address an urgent security risk or comply with the law. We keep action proportionate, explain it as soon as lawful and practicable, and restore service promptly when the reason for suspension is resolved.

We do not charge a penalty for suspension or termination. Any final claim is subject to the actual-loss limits in section 8. We preserve access to your files where lawful and safe.

If we need to discontinue the service for reasons unrelated to your breach, we give at least 30 days’ notice where possible, help you retrieve your files and refund prepaid hosting for the unused period. You owe no remaining minimum-term charges in that case. Your other legal remedies remain available.

11. Personal data

Each party must comply with applicable data-protection law for the personal data it handles. These service terms are not a privacy notice or a substitute for a required data-processing agreement.

Before we process personal data on your behalf, we agree the necessary written processing terms, including the purpose and duration, data and people involved, security, authorised providers, incident assistance, and return or deletion of data. This may apply to hosting and server logs as well as separately quoted contact forms. We identify the relevant providers and arrangements before the affected service starts.

For a separately agreed form, we also agree who receives submissions, any storage and retention, charges and usage limits. The site must have appropriate privacy information before collecting visitors’ information. Analytics, advertising cookies or similar tracking are not included or added without separate agreement and the necessary privacy and consent arrangements.

12. Problems, remedies and responsibility

We will provide the service with reasonable care and skill, as described and within the agreed schedule, subject to any changes we agree with you. Tell us promptly about a problem so we can investigate and put it right.

If you are a consumer, applicable rights include requiring faulty services to be performed again at no extra cost, within a reasonable time and without significant inconvenience, or an appropriate price reduction where the legal conditions are met. A reduction can be the full price where appropriate. Other statutory remedies, including for digital content where applicable, remain available. Launch approval and revision limits do not remove these rights.

We are responsible for losses caused by our breach to the extent required by applicable law. Nothing in these terms excludes or limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded or limited. We do not use a blanket disclaimer for data loss, security failures or third-party hosting problems.

Please send complaints to [email protected]. We will investigate and explain our response. If a consumer complaint cannot be resolved, we will provide details of an appropriate certified alternative dispute resolution body and say whether we are willing or obliged to use it. You retain the right to go to court.

13. Applicable law and changes

Scots law governs the contract. Consumers keep any mandatory protections of the law of their country of habitual residence and may bring proceedings in the courts available to them under applicable law. For business customers, the Scottish courts have jurisdiction.

The version supplied with your order applies to it. Updating this webpage does not retrospectively replace your agreed terms. Changes to your contract require your agreement, except for price changes made under section 6. If a provision cannot lawfully be enforced, that does not remove your statutory rights or invalidate the remaining provisions.
